1. License Grant
PlayPane grants you a non-exclusive, non-transferable, revocable license to install and use the software on a single device strictly for personal or internal business purposes.
2. Restrictions
You may not:
Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code.
Modify, distribute, sublicense, or reproduce the software.
Use the software for illegal or unauthorized purposes.
3. Software Licensing, Activation and Ownership
The software is licensed, not sold. All intellectual property rights remain with PlayPane or its licensors. Some software requires a license key or activation file. By purchasing, you agree to follow the terms of use and restrictions.
4. No Warranty
THE SOFTWARE IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. USE AT YOUR OWN RISK.
5. No Refunds
All sales are final. PlayPane does not offer refunds or exchanges under any circumstances unless required by law.
6. Limitation of Liability
IN NO EVENT SHALL PLAYPANE, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. Indemnification
You agree to indemnify, defend, and hold harmless PlayPane, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your use or misuse of the software, any violation of this agreement, or any breach of the representations, warranties, and covenants herein.
8. Updates
PlayPane may update or modify the software at any time without notice. These updates may change or remove certain features.
9. Termination
This agreement is effective until terminated. It will terminate automatically without notice from PlayPane if you fail to comply with any provision. Upon termination, you must destroy all copies of the software.
10. Governing Law
This agreement shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.
